Key Conventions

1. United Nations Framework Convention on Climate Change (UNFCCC)

The UNFCCC establishes a global response to climate change, requiring signatories to report greenhousegas inventories and develop Nationally Determined Contributions (NDCs). The convention itself does not set emission limits; instead, it provides the platform for subsequent protocols and agreements, most notably the Kyoto Protocol and the Paris Agreement.

2. Convention on Biological Diversity (CBD)

4. Convention on the Protection of the Marine Environment of the North-East Atlantic (OSPAR Convention)

Important Protocols

Kyoto Protocol (1997)

First legally binding commitment under the UNFCCC, establishing quantified emission reduction targets for Annex I countries. The protocol introduced carbon markets through three mechanisms: Joint Implementation, the Clean Development Mechanism, and Emissions Trading.

Paris Agreement (2015)

Unlike Kyoto, the Paris Agreement is universal; every Party submits an NDC outlining its mitigation, adaptation, and finance plans. The agreement emphasizes transparency, a global stocktake every five years, and a ratchetup mechanism to increase ambition over time.

Cartagena Protocol on Biosafety (2000)

Minamata Convention on Mercury (2013)

Aims to protect human health and the environment from mercury emissions and releases. It controls the entire lifecycle of mercury, from mining to waste management.

Budapest Convention (1991)

Focuses on preventing pollution of the Danube River, establishing a comprehensive waterquality monitoring network and a system of permits for discharges.

While the legal frameworks are robust, implementation varies widely:

  • Financial Resources: Developing nations often lack the funds needed to meet commitments. The Green Climate Fund and other multilateral financing mechanisms aim to bridge this gap.
  • Technology Transfer: Access to clean technologies is essential for compliance, yet intellectualproperty rights and cost barriers hinder widespread adoption.
  • Compliance Monitoring: Data gaps and weak reporting systems reduce the effectiveness of transparency mechanisms.
