What is RERA?
The Real Estate (Regulation and Development) Act, 2016 (RERA) is a landmark legislation introduced by the Government of India to bring transparency, accountability, and efficiency to the realestate sector. Each state implements the Act through its own Real Estate Regulatory Authority. In Gujarat, the Gujarat Real Estate Regulatory Authority (Gujarat RERA) was constituted under the Gujarat Real Estate (Regulation and Development) Act, 2016 and began operations in 2017.
Key Objectives of Gujarat RERA
- Protect the interests of homebuyers and other consumers.
- Ensure fair practice and transparency in realestate transactions.
- Promote timely completion and handover of projects.
- Regulate the activities of realestate developers, agents, and promoters.
- Facilitate speedy dispute resolution.
Scope and Coverage
Gujarat RERA applies to all residential and commercial projects where the carpet area exceeds 500sqm (5,382sqft) or where the cost of the unit is more than INR10million. The Act also covers:
- Housing societies and cooperative housing societies.
- Realestate brokers and agents.
- All parties involved in marketing, sale, and construction of a project.
Project and Agent Registration
Developer Registration
Every developer with a project falling within the scope must register the project on the Gujarat RERA portal before launching any marketing or sales activity. The registration process includes:
- Submitting the application form along with required documents (title deeds, approval letters, financial statements, etc.).
- Paying the prescribed fees (generally 0.5% of the project cost up to a maximum).
- Receiving a unique registration number and a public RERA Card for the project.
Agent/Broker Registration
Realestate agents must also register on the portal. The key steps are similar to developer registration, but the fee is lower (about INR5,000). Registered agents receive an Agent ID which must be displayed on all advertisements.

Frequently Asked Questions (FAQ)
1. Is RERA applicable to projects under INR10million?
No. The Act applies only to projects where the carpet area exceeds 500sqm or the price per unit is above INR10million.
2. Can I transfer my RERA registration to another developer?
No. The registration is specific to a developer and a project. If a project is taken over, the new developer must apply for a fresh registration.
3. What is an escrow account?
An escrow account is a bank account where the buyers money is kept separate from the developers general funds and is released only for construction-related expenses, as per the sanctioned plan.
4. How long does a RERA dispute take to resolve?
The Authority aims to decide within 60 days of the hearing, but complex cases may take longer. Many disputes are settled through mediation facilitated by RERA.
5. Do I need a lawyer to file a complaint?
While not mandatory, legal assistance can help prepare a stronger case, especially for large sums or intricate contractual issues.
