Housing Choice Voucher (HCV) Overview

What is the Housing Choice Voucher Program?

The Housing Choice Voucher (HCV) program, commonly known as Section 8, is a federal assistance initiative administered by the U.S. Department of Housing and Urban Development (HUD). It provides eligible lowincome families, the elderly, and persons with disabilities with a subsidy that helps them afford safe and decent housing in the private market.

Unlike traditional public housing, vouchers give families the flexibility to choose where they want to live, as long as the unit meets HUDs health and safety standards and the landlord agrees to accept the voucher.

Who Can Apply?

Eligibility is primarily based on income, but other factors are considered:

  • Income Limits: Usually set at 50% of the area median income (AMI). Families earning up to 30% of AMI are given priority.
  • Household Size: Determines the size of the unit that can be rented.
  • Civil Rights: Applicants cannot be excluded based on race, color, national origin, religion, sex, familial status, or disability.
  • Criminal History: Certain convictions (e.g., drug-related offenses) may affect eligibility.

Each public housing authority (PHA) may have additional preferences, such as homelessness, veterans, or victims of domestic violence.

How the Program Works

1. Application and Waiting List

Applicants submit a form to their local PHA. If the waiting list is closed, they must check back regularly for openings.

2. Determination of Payment Standard

The PHA establishes a payment standard for each area, representing the typical rent for a modestsize, nonluxury unit. The voucher covers up to 70% of this amount.

3. Finding a Unit

Voucher holders search the private market, contacting landlords directly. The unit must pass a HUD inspection and the rent cannot exceed the payment standard unless the PHA approves a higher amount.

4. Lease and Payment

Once a unit is approved, the tenant signs a lease with the landlord. The tenant pays the difference between the rent and the voucher subsidy, commonly called the tenant portion. The PHA pays the landlord directly.

5. Ongoing Responsibilities

  • Annual recertification of income and family composition.
  • Periodic unit inspections to ensure compliance with housing quality standards.
  • Timely rent payments from the tenants share.

Tenant Rights and Responsibilities

Voucher recipients retain many of the protections afforded to other renters:

  • NonDiscrimination: Landlords cannot deny a voucher holder solely because of the voucher.
  • Quiet Enjoyment: Tenants have the right to live without undue interference.
  • Repair and Maintenance: The landlord must keep the unit in decent condition; tenants can report violations to the PHA.
  • Lease Renewal: Tenants have the same renewal rights as other renters, provided they remain compliant.

Tenants must also keep the PHA informed of any changes in income, household members, or contact information.
