National Building Regulations and Building Standards Act 103 of 1977 (as amended)
Overview
The National Building Regulations and Building Standards Act 103 of 1977 (hereafter the Act) is the principal legislation governing the design, construction, alteration and demolition of buildings in SouthAfrica. Enacted to promote safety, health, accessibility and environmental sustainability, the Act establishes a uniform set of technical standards and a regulatory framework applicable to all provinces and municipalities.
Since its inception, the Act has been amended several times to reflect advances in engineering, changes in social policy and emerging sustainability concerns. Its primary objectives are to:
Protect life and property by mandating minimum safety standards.
Ensure that buildings are accessible to persons with disabilities.
Promote energy efficiency and responsible use of resources.
Provide a clear, enforceable process for approvals and inspections.
Key Provisions
1. Scope and Application
The Act applies to all structures intended for human occupancy, including residential, commercial, industrial and public buildings. It also covers ancillary works such as foundations, retaining walls, and temporary structures.
2. Building Standards
The Act refers to the National Building Regulations (NBR), a detailed set of technical criteria covering:
Fire safety (means of escape, fireresistant materials, detection systems).
Sanitation and water supply (plumbing, sewage, rainwater management).
Ventilation, lighting and acoustics.
Accessibility for people with disabilities (ramps, lifts, tactile signage).
Energy efficiency (insulation, glazing, renewable energy integration).
3. Classification of Buildings
Buildings are classified from Class1 to Class9 based on their use and occupancy, each with specific regulatory requirements. For example, Class1 (singlefamily dwellings) has less stringent firesafety provisions than Class5 (office buildings).
4. Approval Process
Before construction, the applicant must submit a complete set of drawings and specifications to the local authority. The authority reviews compliance with the NBR and issues a building approval. The process includes:
Preapplication consultation.
Submission of plans and supporting documents.
Technical review and comment.
Issuance of an approval letter with conditions.
5. Inspections and Occupancy Certificate
During construction, authorised inspectors verify that the work conforms to approved plans. Upon satisfactory completion, an Occupancy Certificate is issued, allowing lawful occupation.
6. Enforcement and Penalties
The Act empowers municipal officials to issue stopwork orders, enforce remedial works and levy fines. Noncompliance can result in criminal prosecution, especially where safety is jeopardised.

Amendment Act 47 of 2011 refined the classification system and introduced new provisions for mixeduse developments.
Amendment Act 22 of 2020 strengthened the enforcement regime and introduced stricter penalties for noncompliance.
Each amendment is published as a separate statutory instrument and incorporated into the consolidated version of the NBR, which is available on the Department of Public Works and Infrastructure website.
