Rajasthan Real Estate (Regulation and Development) Rules, 2017

  • Allotment Letter: The document issued by the promoter confirming the allocation of a unit to a buyer.
  • Carpet Area: The net usable floor area of an apartment, excluding the thickness of inner walls.
  • Project: Any development that includes a building or a land parcel meant for sale or lease.

Registration of Projects & Agents

Project Registration

Every realestate project covering an area of 500sqm or more, or involving more than eight apartments, must be registered with the Rajasthan Real Estate Regulatory Authority before advertising or selling any unit. The application must include:

  • Title deed and landuse approvals.
  • Detailed project plan, layout, and carpet area calculations.
  • Bank guarantee or escrow account details.
  • Declaration of the promoters past project performance.

Agent Registration

Realestate agents are required to obtain a registration certificate that is valid for a period of three years. The registration process involves:

  • Submission of identity and address proof.
  • Payment of the prescribed fee (Rs. 5,000 per annum).
  • Providing a declaration that the agent has not been convicted of any offence under the Act.

Mandatory Disclosures

Promoters must publish the following details on the official RERA website within 30 days of registration:

  • Approved plan, layout, and schedule of development.
  • Exact carpet area of each unit and the price per square foot.
  • Details of all approvals, including environmental and fire safety clearances.
  • Timeline for completion and possession.
  • Financial statements indicating the source of funds and the status of the escrow account.

Failure to update information within the stipulated time is treated as a contravention of the Rules.

Financial Safeguards

One of the most significant provisions is the creation of an Escrow Account:

  • All buyer advances must be deposited into an escrow account opened with a scheduled bank.
  • Funds can be withdrawn only for scheduled expenditures such as land acquisition, construction, and statutory payments.
  • The bank must certify that withdrawals correspond to the progress of construction, thereby preventing diversion of buyer money.

Additionally, a Bank Guarantee equivalent to 10% of the total project cost must be furnished to assure completion in case of promoter default.

Complaint Redressal Mechanism

Buyers, agents, and other stakeholders can file complaints with the Rajasthan Real Estate Regulatory Authority. The process is as follows:

  1. Online filing of a complaint on the RERA portal.
  2. Submission of supporting documents within 30 days of filing.
  3. Authoritys acknowledgment within 7 days and a hearing scheduled within 30 days.
  4. Final order issued within 60 days of the hearing.

The Authority may direct the promoter to either rectify defects, compensate the buyer, or, in severe cases, levy a penalty.

Penalties & Offences

Noncompliance attracts heavy penalties designed to deter malpractice:

  • Failure to register a project up to Rs. 10lakhs or imprisonment for 3 years, or both.
  • Nondisclosure or false information up to Rs. 5lakhs per offence.
  • Nonmaintenance of escrow account up to Rs. 1crore per project.
  • Nonissuance of title deed within 60 days of possession fine of Rs. 25,000 per day.

Repeated violations can lead to cancellation of the registration certificate and prohibition from undertaking any future projects in Rajasthan.
