TamilNadu Real Estate (Regulation and Development) Rules2017

3. Registration of Real Estate Projects & Agents

3.1 Project Registration

Every realestate project must be registered on the TamilNadu Real Estate portal before any advertisement or sale. Required documents include:

  • Title deed or lease deed of the land.
  • Approved building plan and completion schedule.
  • Estimation of total project cost.
  • Bank guarantee or escrowaccount details.

The registration is valid for a period of five years and may be renewed.

3.2 Agent Registration

Any person or firm acting as a realestate agent must obtain a registration number. The process is similar to project registration, requiring proof of identity, address, and a declaration of no prior criminal record. Unregistered agents are liable for a penalty of up to 1lakh per sale.

4. Mandatory Disclosures & Advertising

Developers must publish a Project Information Disclosure Statement (PIDS) on the portal and prominently on sales brochures. The PIDS must contain:

  • Legal title of the land and ownership details.
  • Exact location, plot size and total carpet area.
  • Approvals from local authorities (building, fire, environmental).
  • Project timeline commencement, possession, and handover dates.
  • Breakup of total cost, including land, construction, and other charges.
  • Details of the escrow or bank guarantee.

Any change in the above information after registration must be updated within 15days, and a notice must be sent to all buyers.

5. Financial Safeguards

The Rules introduce two primary mechanisms to protect buyer funds:

5.1 Escrow Account

Developers may opt to deposit the amount received from buyers into a regulated escrow account. The escrow can be released only for:

  • Land acquisition.
  • Construction-related expenditures as per a preapproved schedule.
  • Payment of statutory dues (taxes, labor welfare).

Release of funds requires a certificate from a chartered accountant and an audit report of the construction progress.

5.2 Bank Guarantee

If an escrow is not used, a bank guarantee covering at least 10% of the total project cost must be furnished. The guarantee is invoked by the Real Estate Regulatory Authority (RERA) in case of default.

6. Complaint Redressal Mechanism

Each district in TamilNadu has a Real Estate Regulatory Authority (RERA) office. Buyers can file complaints online or at the office for issues such as:

  • Delay in possession beyond the stipulated date.
  • Nondisclosure of material facts.
  • Violation of approved plans.
  • Improper use of buyers funds.

RERA must acknowledge the complaint within 15days and issue a notice to the developer within 30days. The authority can order compensation, specific performance, or deregistration of the project.

7. Penalties & Enforcement

Noncompliance attracts stringent penalties:

  • Failure to register a project up to 5lakh or imprisonment up to 6months.
  • Wrong or misleading disclosures up to 10lakh per violation.
  • Nonpayment of bank guarantee or escrow the developers licence may be suspended for up to one year.
  • Repeated violations permanent deregistration and blacklisting from future projects.

The State RERA also has the power to order the attachment of assets and direct the recovery of amounts due to buyers.

8. Impact on Buyers & Developers

For Buyers: The Rules have increased confidence by ensuring that essential information is available before purchase and that financial contributions are protected. The fasttrack adjudication reduces the time taken to resolve disputes, often within six months.

For Developers: While compliance entails additional administrative effort and costs (registration fees, escrow management, audits), it also creates a level playing field and discourages unscrupulous practices. Transparent projects tend to attract more serious buyers and better financing terms.
